These Terms of Use (“Terms”) govern your access to and use of www.emphasis.energy (“Site”) and the Emphasis Energy app for iPhone (“App”). By using the Site or the App, you agree to these Terms.
You agree to:
All content on the Site and in the App, including text, graphics, logos, and software, is owned by or licensed to Emphasis Energy LLC and is protected by copyright and other intellectual property laws. You may not use or reproduce content without our written permission. Cards you share from the App may be shared freely with the source credit left intact.
If you submit feedback or suggestions, you grant Emphasis Energy LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content.
The Site and the App are provided “as is” without warranties of any kind. We do not warrant that the Site or the App will be error-free or uninterrupted. Plant and utility figures are public data reported by third parties to the U.S. Energy Information Administration and the U.S. Census Bureau. We present them as reported and do not warrant their accuracy or completeness.
To the maximum extent permitted by law, Emphasis Energy LLC shall not be liable for any indirect, consequential, incidental, or punitive damages arising out of your use of the Site or the App.
The Site may contain links to third-party websites. We do not control or endorse those sites and are not responsible for their content or privacy practices.
The App is licensed, not sold, to you through the Apple App Store under Apple's standard Licensed Application End User License Agreement, which applies in addition to these Terms. Apple is not responsible for the App or its content.
Emphasis Pro is an optional auto-renewing yearly subscription sold and billed by Apple. The price is shown in the App before purchase and may vary by region. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period in your iPhone Settings. Refunds are handled by Apple under its policies.
Builds distributed through TestFlight are pre-release software. Features, limits, and data may change or be reset before the App Store release.
Collecting a plant requires being physically within range of it. You are responsible for obeying traffic laws, respecting private property and posted restrictions, and keeping your attention on the road. Never operate the App while driving; the driving session is designed to be started before you drive and to work without touching the phone.
You may sign in with Apple to collect plants and use the leaderboard. Choose a handle that is not offensive or misleading. We may remove leaderboard entries or accounts that attempt to spoof location, manipulate scores, or abuse the service. You can delete your account at any time from Profile ▸ Delete account.
Emphasis Energy is not affiliated with, endorsed by, or sponsored by the U.S. Energy Information Administration, the U.S. Census Bureau, or any plant or utility shown in the App.
We may suspend or terminate your access to the Site or the App at our discretion, without notice, if you violate these Terms.
These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict of laws principles.
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Site or the App constitutes acceptance of the revised Terms.
